Shooting Appeal Rejected
The Mississippi Court of Appeals has rejected an appeal from a man accused of taking his three teenage nephews with him to shoot his ex-girlfriend's new boyfriend.
Court records say Charles Moore was drinking beer with his nephews on May 22, 2009, when he drove to his ex-girlfriend's trailer in Holmes County. Two of the nephews opened fire on a car parked in front of the trailer.
Prosecutors say Moore aimed through the bedroom window and shot Derrell Blair in the head, severely injuring him. Moore was convicted of aggravated assault and conspiracy and sentenced to twenty years. Two nephews pleaded guilty to conspiracy.
Moore argued on appeal that there should have been a mistrial because two witnesses mentioned his previous incarceration.
The Appeals Court rejected that argument Tuesday.
