Germantown Police Retreat From Blood Test Threat

Germantown police concede their earlier news release about a “no refusal” DUI enforcement weekend was a bit over the top.

A recent release stated officers would get a warrant to draw blood from suspected drunken drivers over the Labor Day holiday weekend if drivers refused a breath test.

Tennessee does not allow the mandatory blood tests.

Germantown Police Capt. Marc Molina told The Commercial Appeal officers won’t be blood testing “every single person” stopped on suspicion of DUI and said the release was “a little bit of overkill”

But Molina said the city is using federal funds to pay for the stepped-up enforcement.

Germantown City Prosecutor Joe Lee Wyatt said drivers can refuse a voluntary breath, blood or urine test, but the consequence is being taken to jail.
