Supreme Court orders new murder trial for Climer

NASHVILLE, Tenn. (AP) – The Tennessee Supreme Court has ordered a new trial for a Gibson County man who was convicted of killing and dismembering his mother. The unanimous opinion issued Friday said that statements David H. Climer Jr. gave to police should not have been admitted into evidence because prosecutors failed to show that he understood his rights and waived his right to a lawyer before being interrogated.
The case involves the 2007 slaying and dismemberment of Doris Deberry. The Supreme Court said police should have gotten Climber to sign a paper saying he understood his rights and they were wrong to tell him that he was not allowed to have a lawyer at the time he asked for one.
Police said Climer later denied killing his mother but admitted to dismembering her.
