Mike Presson chose not to take the stand on Wednesday at his own trial, and still 19 counts were dropped against him. “What the state has brought you here for depreciates every real victim raped,” said Presson’s Attorney, Joe Byrd Junior. Of Presson’s 44 original counts, Judge Roy Morgan dropped 19 because he said the state failed to show enough evidence. “He can have one of the best attorneys in town he can have a jury consultant, expert witness but what he cannot do is change the facts of this case,” said the state prosecutor, Rolf Hazelhurst. Attorney Hazelhurst was aware one of his victims falsely cried rape on a boy at school but says this kind of allegation is normal of a girl in her situation, and Dr. Lisa Piercy agrees,”Well how did that person do with it before I tell my mom or whoever change the details.” Little details the victims did not share is what makes forensic psychologist Dr. Robert Kennon question the accusations against Presson, “Most people who had been abused say I remember the way it felt, I remember being scared, I remember it was hot, I remember sweating, I remember.” Shaking, afraid and often tearful, the girls took to the stand on Tuesday to share their side of the story, but when Presson was given the opportunity to testify, he declined. “Is it true you voluntarily knowingly and intelligently make a decision no to testify at your own trial?, said Judge Roy Morgan. “Yes, sir, ” replied Presson.
