DUI Results Questioned In Kentucky
Hundreds of drunken driving cases in Jefferson County are under review because four Breathalyzer technicians let their certifications lapse.
Jefferson County Attorney Mike O’Connell told The Courier-Journal that his office found out about the issue Tuesday and has been reviewing cases to inform defense attorneys, police officers and judges . O’Connell said the certifications had expired in September and about 600 cases were affected.
He called the Breathalyzer test “the single most important piece of evidence in the trial” and said if it is thrown out some cases could be dismissed.
Louisville Department of Corrections Chief of Staff Dwayne Clark said the certifications lapsed because technicians were allowed to monitor their own recertification. Clark said the department will monitor it from now on.
