KY Supreme Court Upholds Wage Law

The Kentucky Supreme Court has upheld the state’s prevailing wage law and says the statute does not violate either the state or federal constitutions.

The decision handed down Thursday turned away an attack brought by TECO Mechanical Contractor Inc. The company claimed the law violated the due process requirements by failing to give contractors a hearing before the state Labor Cabinet assesses back wages and civil penalties. The company also claimed that the law improperly gave judicial authority to the Labor Cabinet.

The high court unanimously found that the law doesn’t violate due process or grant the state any impermissible powers.

A prevailing wage law requires employers to pay the hourly wage, usual benefits and overtime, paid to the majority of workers, laborers, and mechanics within a particular area.
