Jackson Drops Nuisance Action Against Mix Factory; Intends to Refile

JACKSON, Tenn. – The City of Jackson has dismissed a public nuisance action against the Mix Factory, but that may not be the end of the actions against the business. According to Jay Bush, the attorney for The Mix Factory, LLC and FPB Investments, the city dismissed the complaint, Monday. The action was scheduled to be heard in Madison County Chancery Court, Tuesday. Bush stated in a news release that The Mix Factory has employed two uniformed Jackson police officers since August of 2011 and the number of police calls to the facility has dropped dramatically since that time. According to the release, “An analysis of the incident reports made by the Jackson Police Department shows that the number of reports attributed to 63 Heritage Square from August of 2011 to August of 2012 were reduced by more than half from the prior year.” However, the dropping of this public nuisance action may not be the end of the court battle between the city and The Mix Factory. According to Mayor Jerry Gist, the City of Jackson fully intends to refile the public nuisance action with additional claims against the business in the near future. Due to the rules of the court, the public nuisance action cannot be amended to add additional charges or claims. During the investigation of the nuisance action, the city reportedly found additional charges they wanted included in the action. Mayor Gist stated the new claims will include alleged violations of Tennessee liquor laws. We will continue to follow this story and will have more details as they become available.
