Hardin Co. Attorney Suspended from Practicing Law

SAVANNAH, Tenn- A Hardin County attorney has been suspended from practicing law for two years. Thursday, the state Supreme Court handed down the ruling against James Powell of Savannah. According to a release from the Board of Professional Responsibility, Powell caused several overdrafts to a client’s trust account and neglected to properly represent a former client. Along with his two-year suspension, Powell has been ordered to pay restitution and the costs of his disciplinary proceedings. Via email, James Powell stated that, “The overdraft involved the attorney escrow account as I was closing my practice and no client funds were involved and I was forced to withdraw from all cases due to my being suspended after being falsely being accused of perjury and convicted. All files were turned over to another attorney for handling after I was not allowed to continue. ” He went on to say that all of the issues related to this occurred as a result of this suspension. “The case is on appeal to the Tennessee Supreme Court and Post Conviction issues are also pending where I can prove actual innocence among other issues which will be raised.”
