Verdict reached in case of man accused of kidnapping and raping wife

CHESTER COUNTY, Tenn.- After five hours of deliberation, a Chester County jury delivers a verdict that surprised many who have followed the kidnapping and rape case. Seth McCarty was charged with kidnapping and raping his wife while threatening her with a machete last July. During closing arguments, prosecutors argued this was no “exciting rendezvous” with his wife. “No friend, if she was on board for that we’d see different results. We would see different medical results. We wouldn’t see this. If you were having a good time and having sex like the good ole days, why is she running to neighbors house saying, ‘help me, help me’?” prosecuting attorney, Brian Gilliam asked. McCarty was found not guilty of all charges including attempted murder, aggravated rape, especially aggravated kidnapping and aggravated burglary. The jury said he was guilty of aggravated criminal trespassing, which is something his attorney argues is due to frequent panic attacks. “When you have a panic disorder, doesn’t take much to trigger it. And I would say a machete being thrown in your direction is a pretty good trigger,” Kandi Collins said, McCarty’s attorney. McCarty’s lawyer argued his wife set him up. In the end, the jury sided with him. McCarty is scheduled for sentencing in August. He could face up to 11 months and 29 days in jail.
