State seeks death penalty in Bobo case; gag order possible

DECATUR COUNTY, Tenn. — The state will seek the death penalty against all three suspects in the Holly Bobo case, the prosecution announced at a Wednesday hearing. During Wednesday’s proceedings, Judge Creed McGinley also said he may be forced to issue a gag order. “I have never issued a gag order, but I will say that if things continue to be leaked and sensationalized the court might be put in that position,” McGinley said. McGinley says a news station got their hands on an investigative seal and reported it. “I was upset by that, because if an attorney leaked that information to the press I would deem it very unprofessional,” McGinley said. Jason Autry and brothers Zach and Dylan Adams are charged in the disappearance and death of Bobo. All three suspects appeared Wednesday on charges from an indictment handed down last month. Each is charged with premeditated first-degree murder and murder in the perpetration of aggravated kidnapping and aggravated rape. The indictments replaced previous charges. If convicted, Autry and both Adams brothers now could face the death penalty. “When this case goes to trial, it’s a jury that is going to decide the appropriate punishment,” Special Prosecutor Jennifer Nichols said. “They are going to have all the options on the table.” The three men will be able to file motions Aug. 26. Bobo was 20 when she was reported missing from her home in rural Parsons in April 2011. Her disappearance and the subsequent lengthy search attracted national attention. Authorities say her skull was found in woods in Decatur County in September.
