With same-sex marriage legal, who can perform ceremony?

MADISON COUNTY, Tenn. — For many, once a same-sex couple is able to get married, the question becomes who can actually perform the ceremony? As of Monday afternoon, just one same-sex couple had applied for a marriage license at the Madison County Clerk’s office and was later married downtown at a local notary. WBBJ spoke with local officials, including Madison County Clerk Fred Birmingham, about the many offices that can perform a civil union. “There are quite a few people who can perform a civil union in the state of Tennessee,” Birmingham said. “You have county mayors, county clerks, any judgeship — county commissioners can perform a civil union.” Birmingham says even former county clerks can perform a union.
