Memphis police name off-duty officer involved in shooting

MEMPHIS, Tenn. (AP) – Memphis police have identified an off-duty officer who was involved in a fatal shooting this week.

Police said he is 36-year-old Marshall Smith, who has been with the department since June 8, 2009. He remains relieved of duty pending the investigation.

Tennessee Bureau of Investigation spokesman Josh DeVine has said the officer was at a gas station to witness his fiancée picking up her 4-year-old daughter from her ex-husband Sunday night.

The ex-husband, 29-year-old Luis Philipe Soto, who was Hispanic, and the officer, who is black, got into an altercation. DeVine said the officer shot Soto.

Investigators found what they believe to be Soto’s gun near his body, but DeVine said they were still working to determine whether he fired it.

The bureau is investigating two other shootings by Memphis police officers this year.
