Lawsuit over Chilhowee Park gun ban withstands challenge
KNOXVILLE, Tenn. (AP) – A lawsuit contesting the city of Knoxville’s ban on guns at Chilhowee Park has withstood challenge for dismissal and will face another hearing.
The Knoxville News Sentinel reports (http://bit.ly/2e3ZLPT) that on Oct. 3, Knox County Chancellor John Weaver found merit in the city’s argument that plaintiff Liston Matthews did not have standing to file the lawsuit. However, Weaver found that plaintiff Kimberly Bergeron did have standing.
The lawsuit was filed Feb. 11 and was based on the city’s policy prohibiting guns at the Tennessee Valley Fair, even though the event is held at a public park.
Matthews said he didn’t attend the fair last year because of the ban. Bergeron attended, but didn’t take a gun.
