TN bill barring landlords from prohibiting guns in rental properties passes, heads to Gov. Lee’s desk

NASHVILLE, Tenn. (WSMV) – A bill that would bar landlords from prohibiting tenants from keeping firearms in their rental homes, apartments or vehicles on leased property has passed in the legislature and now heads to Gov. Bill Lee’s desk.

The House passed the House Landlord Firearm Act on Monday, after it passed in the Senate in early February.

The bill would make it illegal for landlords to prohibit tenants, or their guests, from legally possessing, carrying, transporting, or storing firearms, firearm components or ammunition on leased premises or in a vehicle on leased property. The bill also creates a cause of action for tenants adversely affected by a landlord’s violation of the prohibition.

Supporters of the bill argued that renters should not lose the ability to defend themselves because they do not own their homes.

Critics argue landlords should retain the right to set rules for their own property.
