Appeals court dismisses police officer’s claims against city

FLOWOOD, Miss. (AP) – The Mississippi Court of Appeals has upheld the dismissal of a former Flowood police officer’s claims that he was forced to resign after refusing to drop drunken driving and assault charges against a prominent resident of the city.

The Clarion-Ledger reports that the appeals court ruled a circuit court judge correctly dismissed Daniel Frank’s wrongful termination claim against the city.

The city argued that Frank lost his job because he acted unprofessionally and used excessive force while arresting the wife of a Flowood physician on suspicion of drunken driving in 2012. The appeals court’s March 19 ruling sided with the city.

An internal affairs investigator concluded Frank had a chance to “deescalate” the situation with the woman he arrested but “belittled” her instead.
