AG: No criminal charges in Kentucky landfill case
FRANKFORT, Ky. (AP) – Kentucky Attorney General Andy Beshear says his office found insufficient evidence to seek criminal charges in the disposal of radioactive waste at an Appalachian landfill.
Beshear’s announcement caps his office’s four-month investigation into the presence of low-level nuclear waste at Blue Ridge Landfill in Estill County.
Though his office determined it could not pursue criminal charges, Beshear said Friday he believes civil damages could be pursued against the company accused of hauling the waste.
Beshear says his office sought “statutory consent” from the state Cabinet for Health and Family Services to pursue such damages. He says the cabinet denied his office’s request but stated it plans to pursue penalties on its own.
The landfill owner has said it was unaware of any dumping of radioactive waste.
