DRESDEN, Tenn. — Over a decade after the death of a mother of four, her husband could be facing time.
Details unfolded at the Weakley County Courthouse during day five of the trial between the State of Tennessee and David Swift.
Monday, a digital forensic examiner stood in as a witness for the State of Tennessee and goes into detail about his investigation of the defendants online activity in the morning hours after Karen Swift went missing at approximately 3 a.m.
“Somebody was on that device at that time. I don’t know if they woke up or they were already up. All I know is that account was accessed to use– to view those images,” said the digital forensics examiner. “And a lot of them are family pictures and things of that nature?,” asked the defense attorney. “Correct,” responded the examiner.
There have been various witnesses that have come to the stand over the last week. They’ve heard testimonies from professional physicians, neighbors, and forensic analysts. The judge states that the prosecution has enough circumstantial evidence to send this case to a jury.
“Your honor the state believes that based upon all this, we’ve given more than enough proof for this to be decision for the jury to make and we would ask that you deny the motion,” said Prosecutor Danny Goodman. “Mr. Goodman, You, eh– does the state acknowledge that the states case primarily, if not totally, is circumstantial?,” asked Judge Hayes. “Yes sir it is,” responded Goodman.
The judge denied the defense motion of acquittal and moves forward with the defenses case in which Swift has not yet decided to testify at this time.
Day six of this trial starts Tuesday as we await to see if David Swift decides to testify in this case.
