State seeks to dismiss Adams’ petition for retrial in Holly Bobo case

SAVANNAH, Tenn. — Both defendants and prosecutors gave statements earlier this afternoon. The defendant is seeking a new trial based on what they allege to be new evidence.

However, the state filed a motion to dismiss Adams’ petition.

“The newly discovered evidence may have resulted in a different resulted trial, if it were presented. If the petitioner was without fault and failing to present without newly discovered evidence and it has to set forth the exact relief that the petitioner is seeking,” said Jennifer Nichols, district attorney general.

Zachary Adams is serving a life sentence without a chance of parole, however with the recanting of the statement made by Jason Autry, the defense is hoping this opportunity may shorten his sentence.

“The issue is did Mr. Adams know Mr. Autry was going to come clean and testify of about his purger testimony in September of 2017 and when did he know it,” said Douglas Bates, Adams’ attorney.

Adams was not required to be in court this afternoon.

His lawyer spoke for him, making the claim that Autry’s initial statement is unreliable due to him admitting to lying earlier this year.

A future court date has not been set at this time.
