Motion to recuse judge in Bobo case overruled by court
DECATUR COUNTY, Tenn. — A recent motion to recuse the judge in the case against three men charged in the death of Holly Bobo has been overruled by the court.
Judge Creed McGinley said during a motions hearing Wednesday morning that there is no conflict on interest in the case.
The motion was filed on behalf of Zach Adams by his defense attorney and asked for Judge McGinley to recuse himself from the case citing an alleged ex parte communication, which is an apparent conversation between him and a state prosecutor.
The judge said any conversation has involved scheduling, which is permitted.
If convicted, all three suspects — Jason Autry and brothers Zach and Dylan Adams — could face the death penalty.
