MS Judge Refuses to Make Texting and Driving Video Public

A judge has refused to make public a video allegedly showing a tractor-trailer driver texting up until the moment of a fatal accident. Circuit Judge Andrew Howorth issued the ruling Tuesday. Marcus Hardin, a driver for Pat Salmon & Sons Inc. of North Little Rock, Ark., collided with the truck of Dwight White who was stopped in traffic on U.S. Highway 78 east of Tupelo on April 9, 2011. Hardin and White died as a result of the crash. White’s wife and daughters filed a wrongful death lawsuit seeking damages. They asked the court to release the video and the defendants, Pat Salmon & Sons Inc., urged the video remain confidential while admitting liability in the accident.
