Mother convicted of killing newborn twins seeks new trial
NASHVILLE, Tenn. (AP) – Appeals judges will decide whether to grant a Hendersonville woman convicted of smothering her newborn twins a new trial.
The Tennessean reports (http://tnne.ws/1Nq2mPZ) that Lindsey Lowe’s lawyer David Raybin told judges Tuesday that a crucial interview Lowe gave a detective before her arrest should never have been used as evidence because he says Lowe was not read her rights and was denied an attorney during questioning.
Prosecutor Leslie Price says the officers read Lowe her rights twice, and according to case law, Lowe waived those rights when she continued to talk.
In January 2014, a judge denied a retrial for Lowe, who was sentenced to at least 51 years in prison after she was convicted of felony murder and other charges stemming from the deaths of Lowe’s twins in 2011.
