Grand jury declines to indict mom in boy’s death

ELIZABETHTON, Tenn. (AP) – An attorney is asking a judge to dismiss a case against an East Tennessee woman charged with neglect and murder in the death of her 4-year-old son after a third grand jury declined to indict her.

Tiffani Holston of Elizabethton was charged in 2012 with aggravated child neglect and murder after her son, Joshua Holston, was struck by a dump truck. She was originally indicted a month after his death, but contested the charges and was re-indicted in 2013. A judge dismissed those charges, which led prosecutors to present the case again this month.

Holston’s attorney says the original charges are still pending. He blamed “unfounded accusations” about Holston’s actions when her child was hit for the charges.
