Mistrial declared for man who shot Union County neighbor
MAYNARDVILE, Tenn. (AP) – A Union County judge has declared a mistrial in the prosecution of an eastern Tennessee man accused of second-degree murder in the slaying of his neighbor.
Multiple media outlets report that Union County Circuit Court Judge Shayne Sexton declared a mistrial Tuesday night because the jury could not agree whether 44-year-old Kevin L. Waggoner was justified in shooting 46-year-old Michael A. Woodby.
Waggoner has admitted to shooting his neighbor Woodby after a confrontation on the night of Sept. 16, 2013 in Luttrell, saying Woodby attacked him and his adult son with a walking stick. The two men had feuded for several years. Prosecutors say forensic evidence does not match Waggoner’s testimony.
The jury, which deliberated for 13 hours, did not reveal its final vote or which way it leaned.
